The procedure, step by step

    Identify a valid legal basis (consent or legitimate interest).

    Inform workers about what data is collected and who accesses it.

    Carry out the impact assessment (DPIA) before activating the system.

    Apply data minimisation and purpose limitation.

  5. 5

    Configure the system: no continuous tracking or tracking outside working hours.

    If you switch systems: when you change your monitoring system or software, update and re-issue the privacy notice, and check whether the national agreement or authorisation for remote monitoring needs renewing. The provider (data processor), the data collected and the methods often change: the one provided earlier is not enough.

There is no specific, published CNPDCP decision on GPS tracking of employees. The law in force (133/2011) provides for lower penalties; the new law 195/2024, in force from 23 August 2026, aligns the framework with the GDPR (up to 20 million euro or 4% of turnover).
